Terms of Service for Fade Aesthetics

1. Acceptance of Terms
By accessing or using the Fade Aesthetics website (“Site”) located at fadeaesthetics.ca, booking services, or purchasing products, you agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Site or any services provided by Fade Aesthetics. These Terms are governed by the laws of the Province of Ontario, Canada.
2. Services Offered
Fade Aesthetics provides the following services:
Laser tattoo removal
Permanent makeup removal
Dark spot treatment
Wrinkle treatment
Stretch mark reduction
These services are performed using the Canela Picoway Laser System. Additionally, Fade Aesthetics offers iS Clinical Facial Products for sale. All services and products are subject to availability and applicable laws and regulations.
3. Eligibility for Services
Clients must be at least 18 years of age or have written consent from a legal guardian.
Fade Aesthetics reserves the right to refuse service if it is determined that the procedure is unsafe, unsuitable, or contraindicated due to medical history or other factors.
Clients must disclose all relevant medical conditions, medications, and treatments during consultations.
4. Booking and Cancellations
Appointments can be booked via the Site or approved communication channels. A non-refundable deposit may be required to secure your appointment.
Cancellations or rescheduling requests must be made at least 48 hours before the scheduled appointment. Failure to comply may result in forfeiture of the deposit.
Fade Aesthetics reserves the right to cancel or reschedule appointments at its discretion.
5. Payment Terms
Payment for services and products must be made in full at the time of service or purchase.
Accepted payment methods include cash, debit, and major credit cards.
Prices for services and products are subject to change without prior notice.
6. No Guarantees or Warranties
While Fade Aesthetics strives to achieve the best possible results, individual outcomes may vary based on factors such as skin type, tattoo ink, age of tattoo, or pre-existing conditions. Fade Aesthetics makes no guarantees or warranties regarding the efficacy of its services or products.
7. Client Responsibilities
Clients must follow all pre- and post-treatment instructions provided by Fade Aesthetics.
Failure to adhere to these instructions may impact the results of the treatment and absolves Fade Aesthetics of liability for adverse outcomes.
8. Content Use and Media Release
By engaging with Fade Aesthetics for services, you grant the company permission to take photos or videos during your treatment, which may include before-and-after images.
You agree that Fade Aesthetics owns all rights to such content and may use it for promotional, educational, or marketing purposes, including but not limited to social media, advertisements, and website use.
Clients may request anonymity (e.g., blurring faces or omitting identifying features) by providing a written request prior to the treatment.
9. Limitations of Liability
To the fullest extent permitted by Ontario law:
Fade Aesthetics shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with its services or products.
The total liability of Fade Aesthetics for any claim shall not exceed the amount paid for the specific service or product giving rise to the claim.
10. Refunds and Returns
Refunds for services are not provided once a treatment has been performed.
Returns for unopened iS Clinical products may be accepted within 14 days of purchase, provided proof of purchase is presented.
11. Compliance with Ontario and Canadian Laws
Fade Aesthetics complies with all applicable laws and regulations in Ontario, including:
Personal Information Protection and Electronic Documents Act (PIPEDA): Governs the collection, use, and disclosure of personal information in the course of commercial activities.
PRIVACY.GC.CA
Personal Health Information Protection Act (PHIPA): Regulates the collection, use, and disclosure of personal health information by health information custodians in Ontario.
ONTARIO
Radiation Emitting Devices Act: Oversees the sale, lease, and import of laser devices in Canada.
CANADA
Any disputes arising under these Terms shall be resolved in accordance with the laws of the Province of Ontario.
12. Privacy Policy
Your privacy is important to Fade Aesthetics. All personal information collected will be used solely for providing services, processing transactions, or improving the client experience. Personal information will not be shared with third parties without consent, except as required by law.
13. Intellectual Property
All content on the Site, including but not limited to logos, images, text, and videos, is the exclusive property of Fade Aesthetics and is protected under Canadian copyright laws.
Unauthorized use, reproduction, or distribution of any content is strictly prohibited.
14. Termination of Service
Fade Aesthetics reserves the right to terminate services to any client at any time if they fail to comply with these Terms or engage in abusive, fraudulent, or unlawful behavior.
15. Amendments
Fade Aesthetics reserves the right to modify these Terms at any time without prior notice. Any changes will be posted on the Site, and continued use of the Site or services constitutes acceptance of the revised Terms.
16. Dispute Resolution
Any disputes or claims arising from or relating to these Terms, the Site, or Fade Aesthetics’ services shall be resolved exclusively in the courts of Ontario, Canada.
